Re-Identifying the History of Paying and Receiving Fifth of Money, Critical Study of Reflected View in Maktab Book, the Process of Evolution

Abstract

Paying the fifth of war spoils and the other incomes are considered as the essential and it has been explicitly considered in Holy Quran. The majority of Shiite scholars believe that asking and receiving the fifth by the prophet’s family and its paying by the Shiites had initiated from the early Islam. However, the author of the Maktab book in the theory of evolution believes that this issue has systematically initiated from the end of imamate of Imam Javad as a religious necessity. The present article investigates the reflected view in this book by the historical- hadith strategy as well as the analytical- reasoning method. Moreover, it endeavors to prove that demanding the fifth by the prophet’s family and its paying by the Shiites has been done since the lifetime of Imam Ali (PBUH) and sometimes, it has not been pointed to due to some security problems and exempting the Shiite from paying the fifth.

Abstract [العربیة]

یعد تأدیة الخمس من غنائم الحرب و سائر الموارد المالیة، من الفروض المصرح بها و المنصوص علیها فی القرآن الکریم. فقد ترى الأغلبیة الساحقة لجمهور علماء الشیعة بأن المطالبة بالخمس من قبل أهل البیت و استلامها ثم تأدیته و دفعه من قبل الشیعة کانت قد بدأت منذ صدر الإسلام. لکن مؤلف کتاب "مکتب در فرایند تکامل "(تالیف الدکتور السید حسین المدرسی الطباطبائی. الکتاب مترجم الی الفارسیه) یرى بأن موضوع الخمس باعتباره فرضا و واجبا شرعیا منظما و مؤطرا ،لم یظهر إلا فی عصر الإمام الجواد(ع).
یسعى هذا المقال، أن یدرس الفکرة المعروضة فی کتاب الأخیر، عبر المنهجیة التاریخیة و الحدیثیة و عبرالمنهج التحلیلی الاجتهادی مؤکدا على أن قضیة الخمس و المطالبة به و استلامه من قبل أهل البیت و تأدیته من قبل الشیعة کانت موجودة فی عصر الأمام علی علیه السلام.لم تشر النصوص التاریخیة لأسباب متعلقة بالحکومة و الأمن إلى أن الشیعة کانت تعفى من دفعها فی حقب من التاریخ.
